An Art Exhibition Celebrating Mental Health and Healing

SUBMISSION GUIDELINES

This exhibition will focus on visual art. All submissions must be 2D original works of art. This includes:

  • Digital or graphic art

  • Painting

  • Drawing / Illustration

  • Mural

  • Photography

  • Collage / Mixed media

 

The exhibition does not include: body art, audio, video, animation, or sculpture. To encourage accessibility across languages and cultures, we are also not including written works.

 

If you are submitting a piece other than digital art or photography, please submit a high quality photo of your work. Avoid shining bright lights on your work to reduce glare. Natural lighting is preferred.

 

Files must be less than 10MB. The image is recommended to be at least 1000x1000 pixels in size, with a 1:1 aspect ratio and a resolution of at least 300dpi. Images with different aspect ratios will be displayed with borders. Accepted file types are: jpg, png, bmp, tiff, pdf. Note: HEIC files not supported.

 

Any submitted captions or artist statements will not be used in the judging process.

 

Submissions are open to artists who:

  • Are 18 years of age, or older as of May 1, 2022

  • Reside in a country that accepts PayPal, as PayPal will be used to transmit cash awards to selected winners (see: https://bit.ly/PPcountries)

  • Represent themselves (no organizations or institutions)

  • Are not employees, contractors, business partners, immediate family members, or anyone residing in the same household as one of the Judges or any one of the staff, facilitators, or board members of Healing Together, Healing Together Nepal, or Healing Together Uganda.

 

Only one (1) submission is allowed per person.

 

Submissions open May 1, 2022 at 10:00am Pacific Standard Time and close May 28, 2022 at 10:00pm Pacific Standard Time. 

 

Public voting is open May 1, 2022 at 10:00am Pacific Standard Time and closes May 28, 2022 at 10:00pm Pacific Standard Time.

ART EXHIBITION TERMS & CONDITIONS

 

These Terms of Use and Conditions (the “Terms”) are an Agreement between you, (“Artist” or “you” or “your”), and Healing Together (“Organization” or “us” or “we” or “our”). These Terms govern your access to and use of the Organization’s website and the third party art exhibition platform, WooBox, (hereinafter, collectively, the “Website”) to submit artwork, as well as the reference and/or use of such artwork by the Organization. All references to the Organization in this Agreement shall include Organization’s affiliates, subsidiaries, successors, licensees, and assigns.

By submitting artwork to the Website, you accept and agree to be bound and abide by these Terms and our Privacy Policy, and the Privacy Policy of our third party art exhibition platform, found at: https://woobox.com/terms. If you do not agree to these Terms, you are not permitted to access or use our Website. By using this Website, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet the eligibility requirements, you must not access or use our website.

Please read these Terms carefully, and feel free to contact us if you have any questions.

Scope of this Agreement. This Agreement applies to any artwork, images, graphics, digital assets, or digital images created or taken by Artist and submitted to the Organization’s Website (collectively known as the “Submission(s)”) as part of the “We Heal Us” Art Exhibition (the “Exhibition”). This Agreement governs the relationship between the parties and no communication or other exchange, shall modify the terms of this Agreement unless agreed to in writing by both parties.

Eligibility. This Exhibition is open only to persons who are 18 years old or older as of the date of submission. Employees, contractors, and/or facilitators of Healing Together, Healing Together Nepal, and Healing Together Heights Uganda, (together, “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Exhibition. Furthermore, Artists who submit work must reside in a country that accepts PayPal, as PayPal will be used to transmit cash awards to selected awardees. By submitting artwork to the Exhibition, the Artist agrees to be fully unconditionally bound by these Terms. You also represent and warrant that You meet the eligibility requirements and that the Exhibition and You entering the Exhibition is not prohibited in Your jurisdiction. In addition, You agree to accept the decisions of the Organization as final and binding as it relates to the Exhibition.

 

Exhibition Period. Artwork must be submitted to the Exhibition between May 1, 2022 at 10:00 AM Pacific Standard Time and May 28, 2022 at 10:00 PM Pacific Standard Time. 

How to Enter:

(a) To participate in the Exhibition, the Artist must submit their work via the Website.

(b) Only one (1) entry is allowed per person.

(c) Submitted artwork can be a digital or graphic artwork, photograph, painting, drawing, illustration, mural, collage, or mixed media artwork. For any work that is not digital in nature, a high resolution photo of the artwork must be submitted. The following artwork will not be accepted: body art, audio, video, animation, or sculpture. To encourage accessibility across languages and cultures, we are also not including written works such as poems, prose, fiction, or nonfiction works. Words and phrases can be included in your artwork but should not be the sole focus of the work. 

(d) Submitted files must be less than 10MB (recommended at least 1000x1000 pixels and at least 300dpi) and must be one of the following file types: jpeg, png, bmp, tiff, or pdf. 

(e) Any submission that contains sexual content, violence, abuse, exploitation, threats, harassment, or that promotes oppression, injustice, discrimination or acts of violence against any child, individual, or group or that otherwise contains content that in the view of the Organization is inappropriate, will not be accepted. The Organization may immediately reject any Submission at the Organization’s sole discretion.

(f) The submission and the Artist must fulfill all Exhibition requirements, as specified in these Terms, to be eligible for an award. 

(g) Submissions that are incomplete or do not adhere to the Terms may be disqualified at the sole discretion of the Organization. 

(h) If You use fraudulent methods or otherwise attempt to circumvent these Terms, your submission may be removed from eligibility at the sole discretion of the Organization.

Artist agrees to the following terms for Artist’s Submission:

License. Subject to the Terms of this Agreement, Artist hereby grants to Organization a non-exclusive, irrevocable, non-transferable, royalty-free, except as explicitly set out herein, worldwide right and license to use, transmit, promote, publicly display, reproduce, distribute, and otherwise use the Artist’s Submission for all noncommercial purposes, including on the Organization’s social media and on the Organization’s Website.

Awards. Three (3) awards will be given to three separate artists based on the following:

People’s Choice Award: Any member of the general public can submit one (1) vote for their favorite work of art between May 1, 2022 at 10:00 am Pacific Standard Time and May 28, 2022 at 10:00 pm Pacific Standard Time (“Voting Period”). The artist whose work has the most number of votes after the close of the Voting Period shall receive a $500 US Dollar award. In the event of a tie, the Judges will select the final winner. 

Judges Choice Awards: Four (4) artist activist judges (the “Judges”) will select two (2) works of art for which the artists shall receive $500 US Dollar awards. The Judges’ selections will be based on the following criteria: creativity, relevance to the theme: We Heal Us, and overall impression. The Judges will make their selections on May 29, 2022 and, if needed to break any ties, on May 30, 2022.

The Judges. The judges are: Benjamin “Ben” Von Wong, Lemny Perez, aka “Dr. Lemny”, Lakiba Pittman, and Antone “Tony” Olivier. 

 

All of the Awardees will be announced on May 31, 2022 via Healing Together’s social media accounts. Awardees will also be contacted by the Organization staff by email on May 31, 2022. Accordingly, arrangements will be made for the delivery of the award monies and the Healing Together Standard Creative Licensing Agreement.

 

License for Award Winners. The Standard Creative Licensing Agreement will require Awardees to grant the Organization a nonexclusive, royalty-free, transferable, irrevocable, perpetual, worldwide license to make, have made, modify, manufacture, reproduce, use, sell, and/or distribute the Submission for a period of two (2) years in order to raise money for the Organization’s mental health and trauma healing programs around the world, in alignment with the Organizations charitable tax-exempt status.

Artist Rights. Unless explicitly stated otherwise, all Submissions and rights relating to them, including copyright and ownership rights in the media in which the Submissions are stored, remain the sole and exclusive property of the Artist. No other use of the Submission is granted without the Artist’s express written consent.

Attribution. The parties agree that any work submitted to the Exhibition which is shared or used by the Organization shall be attributed to the Artist based on the name entered on the Website at the time of Submission.   

Relationship of the Parties. The parties agree that neither Artist nor Artist’s employees or contract personnel are, or shall be deemed to be, employees or independent contractors of Organization. No agency, partnership, joint venture, or employee-employer relationship is intended or created by this Agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this Agreement. Artist and the Submission shall not be deemed a work for hire as defined under Copyright Law. All rights granted to Organization are contractual in nature and are expressly defined by this Agreement.

Representations and Warranties. Artist represents and warrants to the Organization that:

  • Artist is the exclusive, sole owner and author of the Submission and has the right to grant the license.

  • The Submission is Artist’s original creation and does not include any material created by any third parties; that neither the Submission, nor the Organization’s use thereof, will infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation, or the violation of any contract to which Artist is a party.

  • Artist has full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

  • Artist has all the necessary rights, consents, and authorizations required to license the Submission according to these Terms.

  • The Artist does not violate the legal rights of others or contain any materials that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms.

  • That Artist is 18 years of age or older as of May 1, 2022.

 

Please note that content on our Website covers a wide range of art and subject matter and may include visual or written material that some people may consider offensive or inappropriate for children and minors. If you allow your child or anyone else to use your computer or other device, it is solely your responsibility to prevent them from accessing any content that you think is or may be inappropriate for them.

The Artist is not impersonating any person or misrepresenting their identity or affiliation with any person or organization.

You are responsible for both:

  • Making all arrangements necessary for you to have access to the Website.

  • Ensuring that all persons who access the Website through your internet connection are aware of these Terms and comply with them.

Prohibited Uses. You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulations (including without limitation, any laws regarding the export of data or software to and from the US or other countries).

  • For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.

  • To send, knowingly receive, upload, download, use, or re-use any materials that do not comply with these Terms.

  • To impersonate or attempt to impersonate a person, user, entity, or company.

  • To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm the Organization or users of the Website, or expose either to liability.

  • To use the Website in any manner that could disable, overburden, damage, or impair the Website or interfere with any other users use of the Website.

  • To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

 

Indemnification. Artist acknowledges that the Organization is not responsible for, and has no liability for, any use of all or any part of the Submission. Artist agrees to defend, indemnify, and hold harmless and release the Organization, along with its respective officers, directors, employees, agents, assigns, licensees and successors, from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, fees, or causes of action (collectively “Claims”) arising out of or relating to your violation of these Terms including but not limited to Website, content, Submission, including without limitation, any claims of defamation, invasion of privacy, rights of publicity or copyright infringement, or any other right Artist may have.

 

Monitoring and Termination. Organization has the right to:

  • Remove, refuse to accept, post, or transmit Submission for any reason at our sole discretion.

  • Remove Submission from its Website for any reason.

  • Take any action with respect to Submission that we deem necessary, in our sole discretion, including if we believe that such Submission violates these Terms or infringes upon any intellectual property right or other right of any person or entity, threatens the personal safety of user of the Website or the public, or could create liability for the Organization.

  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their rights to privacy.

  • Take appropriate legal action, including, without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website.

  • Terminate or suspend your access to all or part of the Website.

 

Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Website. 

 

You waive and hold harmless the organization and its affiliates, licensees, and service providers from any claims resulting from any action taken by any of the foregoing parties during, or taken as a consequence of, investigations by either the organization or law enforcement authorities.

We do not undertake to review all material before it is posted on the Website, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

Artist has the right to terminate relationship with Organization and withdraw the Submission at any time by contacting info(at)wearehealingtogether.org. Organization will withdraw Submission within five (5) business days of receiving notice of Artist’s desire to withdraw Submission from the Website. Any withdrawn submissions shall not be eligible for awards.

Disclaimer of Warranties. You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our Website for any reconstruction of any lost data. 

To the fullest extent provided by law, we will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the website or any services or items obtained through the website or to your downloading of any material posted on it, or on any website linked to it. Your use of the website, its content, and any services or items obtained through the website is at your own risk. The website, its content, and any services or items obtained through the website are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Neither the organization nor any person associated with the organization makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the website. Without limiting the foregoing, neither the organization nor anyone associated with the organization represents or warrants that the website, its content, or any services or items obtained through the website will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that our website or the server that makes it available are free of viruses or other harmful components, or that the website or any services or items obtained through the website will otherwise meet your needs or expectations. To the fullest extent provided by law, the organization hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

The foregoing does not affect any warranties that cannot be excluded or limited under applicable law.

Severability. If one or more of the provisions in the Agreement is found invalid, illegal or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. Any such provisions will be revised as required to make them enforceable.

Waiver. No action of either party, other than in writing agreed to by the parties, may be construed to waive any provision of this Agreement and a single or partial exercise by either party of any such action will not preclude further exercise of other rights or remedies in this Agreement.

Digital Millennium Copyright Act (DMCA). We respect the intellectual property rights of others. If you believe your copyright in a work has been violated through the Website, Submissions, content, or our services, please provide notice of such claims of copyright infringement to:

You must provide the following information, which we may then forward to the alleged infringer:

  • Describe the copyrighted work or works that you believe has been infringed;

  • Identify the material on the Website that you believe infringes your work, with enough detail so that we may locate it;

  • Provide your contact information, including: full name, address, telephone number, and email address;

  • Provide a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

  • Declare under penalty of perjury that (a) the information you have provided is accurate and (b) you are the owner of the copyright interest involved or you are authorized to act on behalf of that owner; and

  • Provide your physical or electronic signature.

 

If you fail to comply with all of the requirements of Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3) of the DMCA, your DMCA Notice may not be effective. Please be aware that if you knowingly materially misrepresent that material or activity on the Website is infringing your copyright, you may be held liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.

Upon receiving your complaint, we will investigate the claim and may remove content that you believe infringes your copyright, if the claim is deemed to be valid. In addition, we may, at our sole discretion, terminate access by that user who appears to be infringing your intellectual property rights.

Conversely, if you believe that your content was improperly removed, please let us know through the contact information above.

Governing Law and Jurisdiction. All matters relating to the Website and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Washington without giving effect to any choice or conflict of law provision or rule (whether of the State of Washington or any other jurisdiction).

 

Any legal suit, action, or proceeding arising out of, or related to, these Terms, Submissions, or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Washington, in each case located in the City of Seattle and County of King, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
